What must a litigant show in order to get a continuance because he is having difficulty locating or securing the testimony of a witness?
Back of Card:
The movant must show by motion supported by affidavit:
1. That testimony is material and how it is material,
2. That the party has used diligence in securing the testimony and how it was diligent,
3. Cause of the failure of securing the testimony, if known,
4. That testimony cannot be procured from any other source, (not required on a first motion for continuance)
5. If for the absence of a witness, state his name and address and what is expected to be proved by him, AND
6. State that the continuance is not sought for delay only, but that justice may be done. TRCP 252.
